RESPONSE TO MHA'S PRESS RELEASE

I refer to the Ministry of Home Affairs' press release of Friday, 17 May 24. Frankly, I was surprised that Minister Shanmugam had taken the trouble to respond to my facebook post.

I reject the allegation that I had thought “so poorly of former drug abusers”. I don't know how the minister arrived at that conclusion. I have stood up in the past for the weak and was one of the founders of the Criminal Legal Scheme of the Law Society which has today been renamed and reconstituted. Furthermore, some decades ago, I stood up to the late Prime Minister Lee Kuan Yew when he undermined the Law Society.

I am aware that former offenders of drugs or other crimes are sensitive and do not relish publicity or reminders of their past. I was therefore concerned that television coverage of the 120 former drug addicts and their families may not be good for them. I therefore stated my reservation. Since the minister has clarified that all of them were aware that there would be media coverage, I accept that my concern was unnecessary.

While it is true that I do not think the minister can eradicate the drug problem in Singapore, I also do not think that this problem can be solved by leaders of any country. People resort to drugs for many reasons. To believe that the death penalty will solve Singapore's drug crimes is too simplistic.

The minister's approach towards drug offenders has not differed from his predecessors. Our laws have always been harsh towards drug mules while the big-time drug dealers are never caught. And so it is hard for me to accept that the death penalty works. If it did, no one should be caught for drug trafficking today as the death penalty has been our law for nearly 50 years now.

Minister Shanmugam singled out several citizens in his ministerial statement. I am glad that there are still individuals in Singapore who have the nerve to stand up for the powerless. His criticisms of last-minute applications of death row prisoners, several of whom I understand did not have legal representation, is unreasonable. Every life is precious. If a last-minute application can save a life and here I recall the case of Yong Vui Kong who is alive today because of last-minute applications, then I have to disagree that these applications are all unmeritorious and a waste of judges' time.

Minister Shanmugam invites me and others to take legal action against him. This is the problem with many PAP ministers. They cannot engage in debates.

对于内政部长于2024年5月14日发表的声明回应我在脸书上那个的帖问,有劳善慕根部长对此作出回应。坦白地说,我感到[诶出]惊讶。

我拒绝他所提出的我对‘吸毒者缺乏认识’的有关指责。我无法知道部长是如何得出这个结论的。我过去曾经挺身而出为弱势群体发声。我是律师公会属下的一个刑事法律援助创办人之一。它今天已经更名并存重组了。此外,在几十年前,总理李光耀企图控制律师公会时,我也挺身而出捍卫。

我是注意到前涉毒的刑事犯或者其他的刑事犯的问题是敏感的,不喜欢他人公开或提起有关自己的过去。基于此,我关心电视台报道了有关120名前吸毒者及其家人的情况,师傅对他们有好处?我对此保留自己的意见。既然部长已经澄清说,他们注意到有关媒体的报道。为此,我对自己的所关注的问题就没有必要了。

虽然,我知道部长是根本不可能在新加坡杜绝毒品问题的。我同时也不认为,这个问题是世界上任何国家的领导人可以解决的。人民寻找毒品是存在多方面的问题的。如果认为,通过判处涉毒者死刑,可以解决新加坡的涉毒是过于简单了。

部长对待涉毒者的态度与前任有什么不同吗?一直以来,我们对毒枭毫无办法,但是对涉毒者却是非常的严厉。因此,对涉毒者采取死刑的处置,我很难接受。贩毒死刑刑罚已经实施了50年了,但直至今天还不能遏制贩毒活动。

善慕根部长在他发表的声明里提到了数名公民的名字。我为这些被部长点名的公民感到骄傲。因为这些公民有勇气为那些弱势群体发声。他在批评这些公民在为那些即将面对执行死刑的死囚最后一分钟提出申请暂缓执行。这些即将面对死刑犯人是没有任何的代表律师的。这是不合理的,每一条人的生命是值得珍惜的。假设死囚在被执行死刑前可以挽救一名,我们是必须付出努力。这让回想起至今有幸存活下来的前死囚杨伟光(Yong Vui Kong)事件。他就是在其代表律师拉维律师(M. Ravi)在最后一分钟提出申请暂缓执行死刑的。基于此,我只得不同意(部长)说这些最后一分钟提出暂缓死刑是没有根据地,也是浪费法官的时间的说词。

善慕根部长邀请我和其他公民向他提起诉讼。他们无法与(人民)进行直接的论辩有关的课题,而是要求人民对他们提起诉讼。这些就是人民行动党的部长们一贯的作风。
